1. Scope

These Terms and Conditions apply to all orders placed through the online store secret-toys.shop.

These Terms and Conditions apply to consumers and businesses unless expressly agreed otherwise.

The version published at the time the contract is concluded applies to the respective order.

2. Offer and Conclusion of the Contract

The presentation of products in the online store does not constitute a legally binding offer but an invitation to place an order.

By submitting an order, the customer makes a binding offer to conclude a purchase contract.

After the order has been received, an automatic order confirmation is sent by email. This initially confirms only the receipt of the order and does not necessarily constitute its acceptance.

The purchase contract is concluded when we expressly accept the order by email, confirm the shipment or dispatch the goods.

A payment authorisation or charge made before acceptance of the contract does not, by itself, constitute acceptance of the order. If an order is not accepted, any payments already received will be reimbursed.

We reserve the right to reject or cancel orders, particularly if:

• a product is unavailable;
• there is an obvious error in the price, text or product information;
• the delivery address is incomplete or cannot be served;
• there is a reasonable suspicion of fraud or misuse; or
• other objective reasons prevent us from fulfilling the order.

The order details and the contractual terms applicable at the time of the order are stored within the available legal and technical possibilities.

The essential order details are sent to the customer by email with the order confirmation. If a customer account exists, order details may also be viewed there. The contractual terms can also be accessed and saved through our website.

3. Products and Product Representations

We make every effort to display product descriptions, images, colours, measurements and other information as accurately and currently as possible.

Representations may differ slightly from the actual product depending on the screen, device and technical settings used.

The product information displayed in the online store at the time of the order is decisive.

Products must be used only in accordance with their description, instructions for use and safety information.

Products must not be modified, misused or used contrary to the manufacturer’s instructions.

4. Age Restriction

Our products and services are intended exclusively for adults.

Orders through our online store may be placed only by persons aged 18 or older.

By submitting an order, the customer confirms that they are at least 18 years old and authorised to place the order.

We reserve the right to reject or cancel orders if there are reasonable doubts regarding the customer’s age or authority to place the order.

5. Prices and Payment

The prices displayed in the online store at the time of the order apply.

The applicable prices and shipping costs are displayed transparently during checkout before the order is completed.

Where required by law, prices include the applicable value-added tax of the delivery country.

For deliveries within the European Union, legally applicable taxes are calculated in accordance with the relevant rules and the delivery country.

The payment methods offered during checkout may vary depending on the delivery country, order and technical availability.

Payments are processed through the available payment service providers. Their own terms and privacy policies may also apply.

The order will be processed after successful payment confirmation and acceptance of the order.

6. Delivery and Shipping

Delivery will be made to the address provided by the customer during checkout.

Shipping may be carried out directly by a fulfilment or logistics partner appointed by us from the Netherlands or another warehouse located within the European Union.

The customer may therefore receive a shipping confirmation or parcel showing our logistics or shipping partner as the sender.

The estimated delivery time is displayed on the relevant product page, in the shipping policy or during checkout.

Deliveries within the European Union are generally not subject to import duties, provided that the goods have been properly released for free circulation within the European Union.

Partial deliveries are permitted where they are reasonable for the customer. Partial deliveries initiated by us will not result in additional shipping charges unless expressly agreed otherwise.

Delivery times are estimates unless a binding delivery date has been expressly agreed.

Delays may occur due to shipping providers, supply shortages or other circumstances outside our direct control.

The customer’s mandatory statutory rights in the event of a delay remain unaffected.

7. Retention of Title

The goods remain the property of the provider until payment has been made in full, insofar as retention of title is permitted under the applicable law.

8. Withdrawal and Returns

Consumers in the European Union generally have a statutory right of withdrawal for 14 days.

The requirements, deadlines, consequences and exceptions are described in the separate Returns and Right of Withdrawal policy on our website.

For consumers to whom no statutory right of withdrawal applies, we voluntarily grant a 14-day right of return from receipt of the goods, provided that the requirements in our returns policy are met.

The direct costs of a standard return are generally borne by the customer unless otherwise stated in our returns policy or agreed in an individual case.

The right of withdrawal or return may be excluded for sealed goods that are not suitable for return for reasons of health protection or hygiene if the seal has been removed or damaged after delivery.

Mandatory statutory withdrawal, return and consumer rights remain unaffected.

9. Defects and Statutory Warranty

The applicable statutory rights relating to defects and warranties apply.

For deliveries to consumers within the European Union, the mandatory statutory warranty rights of the respective delivery country remain unaffected.

If a product is damaged, defective or incorrectly delivered, please contact us as soon as reasonably possible at kontakt@secret-toys.shop.

To process the request, we may ask for a description of the defect and clear photographs of the product and packaging.

The customer must make the goods available in a reasonable manner for inspection or return where necessary.

In the event of a justified complaint, we will cover the necessary return costs. Mandatory statutory rights remain unaffected.

10. Liability

We have unlimited liability for damage caused intentionally or through gross negligence.

For damage caused by slight negligence, we are liable only where essential contractual obligations have been breached. In such cases, liability is limited to foreseeable and typical damage.

These limitations do not apply to injury to life, body or health or to mandatory statutory liability claims, particularly those arising under applicable product liability law.

To the extent permitted by law, we are not liable for damage caused by improper use, use for an unintended purpose or use contrary to the product and safety instructions.

11. Data Protection

Information about the processing of personal data can be found in the Privacy Policy published on our website.

The online store is operated using Shopify. When the store is used, Shopify, payment service providers, shipping companies, fulfilment partners and other service providers used to process the contract may process personal data.

12. Intellectual Property

The content of the online store, particularly texts, product descriptions, graphics, logos, images and design elements, is protected by copyright or other rights.

Reproduction, modification, distribution or commercial use without prior permission is prohibited unless permitted by law.

The rights of Shopify and other trademark, copyright and rights holders remain unaffected.

13. Applicable Law

To the extent permitted by law, these Terms and Conditions and the contractual relationship between the provider and the customer are governed by Swiss law.

For consumers, mandatory protective provisions of the country in which they have their habitual residence remain unaffected.

The choice of law must not deprive a consumer of the protection granted by mandatory provisions of the law that would apply without this choice.

14. Jurisdiction

For businesses and legal entities, the place of jurisdiction is, to the extent permitted by law, the provider’s registered office in Switzerland.

For consumers, the applicable mandatory statutory jurisdiction rules apply.

15. Changes to These Terms and Conditions

We reserve the right to amend these Terms and Conditions with effect for future orders.

For orders already placed, the version published at the time the contract was concluded generally applies.

16. Severability

If any provision of these Terms and Conditions is wholly or partially invalid or unenforceable, the remaining provisions remain effective.

Where a provision is invalid or unenforceable, the applicable statutory rules will take its place.
